Spirit Lake takes legal action against NCAA

Spirit Lake Tribal Council representatives announced this morning that legal action has been taken against the NCAA over the Fighting Sioux nickname and logo.

According to attorney Reed Soderstrom, representing the Committee of Understanding and Respect, and Archie Fool Bear, individually and on behalf of 1,004 petitioners from the Standing Rock Sioux Tribe, the lawsuit against the NCAA was filed in response to their ruling on the nickname and subsequent sanctions.

The lawsuit involves 12 counts, including copyright infringement, lack of jurisdiction and “intentional infliction of emotional distress on the Sioux people.”

Yeah, I don't really understand their thinking???  In all reality will or can it do any good at this point???  I thought is was a done deal and noone could change the outcome???

So its a threat to take legal action? I dont see what they could do with legal action, they would basically need to sue the NCAA to let UND keep the name AND let them still be in the NCAA. All the NCAA needs to say is sure keep the name now get out of our organization. That would basically end the need for a mascot anyway.

I dont go around guessing cup sizes either I just know a nice rack when I see one.

If UND (admin, students, etc)  would have up and announced "We're getting rid of the Sioux name because we just don't like it associated with the university"  the tribes would have sued the other way, trying to force them to keep it.

I would agree with that as well, all of this just seems to be hurting the institution.

Simply amazing that certain individuals would let this happen. This issue could take down all of the UND sports basically besides hockey. Football, Basketball, Baseball, Volleyball etc that are trying to find a conference, this could be the dagger for those.

Can easily see the Big Sky saying "See Ya" if this issue doesn't die quick. Doubt any other NCAA conference in their right mind would take on UND with this issue still living.

Would be nice to see UND get booted from the Big Sky, drop the name, end this foolishness and then join the MVFC and Summit and play the schools that they should be anyway. Interesting stuff!

I find the letter fascinating to be honest with you.  I love the hypocrisy of the NCAA that is pointed out about the Fighting Illini and the Seminoles.  However, I doubt the letter/lawsuit will do a dang bit of good.

Does anyone else smell that funny smell? Now I recognize it!  It's Al Carlson!!!!!!!  If this doesn't involve Al trying to save face then I am a bad guesser!  I personally like the logo and name!, but if it's going to be detrimental to the school then get rid of it and move on!  Al  should of stayed out of this controversy from the start!  Go! AL!  Go! See how much you can screw up things for UND before it's all over!

This is true...and I applaud the Spirit Lake Tribe for stepping up and having the kahunas  to do what the worthless Board of Higher Education miserably failed at…my concern is this has the makings of a very long and drawn out process and should have been initiated several years ago when this first came about.

I do feel if the university, the State the Board of Higher Ed and the tribe started this fight when this was first announced we may have had a chance to take on the NCAA…I just don’t think the tribe can do it alone and this late in the game….

UND hockey is known all over the USA  so why would it matter if they are in the NCAA. There are highschool hockey players that are being eyed by the pros and the high schools have nothing to do with the NCAA
The NCAA just wants it their way or the highway  take the highway   How many hockey players are drafted into the NHL because of the NCAA

As of now it is the law to keep the logo  Al Carlson doesn't like it so the state should or the board should just send him packing

Agreed, The "almighty" Sioux Hockey would be SO feared playing a schedule full of non NCAA schools. The young kids would really be lined up to play for such an outfit then!

What about the fact that UND should be able to keep the mascot and name under "freedom of speech"--guaranteed by the US Constitution?

Spirit Lake should have the right to let UND use the nickname. Straight and Simple. There is no need for Standing Rock approval.


The NCAA is denying Spirit Lake's right to the name and that is wrong. This lawsuit cannot hurt UND because the NCAA will not kick them out for this reason. This lawsuit is out of the State's hand and if Spirit Lake does win the lawsuit UND will be able to keep the logo if they choose to do so!
