posted by: Stizostedion vitreum. Another poor soul lost his life after making poor decisions under the influence of alcohol. A man died yesterday after being thrown from his motorcycle on I-94 near Valley City.

Once you have alcohol in your blood...even if you are just buzzed...your judgment is altered and you will do things you would never have done sober. This man was not a bad person. He did not deserve to die. He simply made a VERY bad decision to get on that motorcycle after having even one drink. My condolences to his friends and family. Thank God he did not kill anyone else.

The 24/7 program being discussed is for "pretrial" defendants; those individuals charged, yet not convicted of a crime. Most probation/parole departments (including North Dakota) already have a variety of similar programs for both drug and alcohol abusers (post-conviction). Definitely not a new concept.

In many courts, release on bond may be determined by a number of factors, but most notably: risk of danger to the community and risk of non-appearance for future hearings. This 24/7 program is designed to aid in risk reduction. If the Court believes a defendant is a manageable risk of danger while awaiting trial, drug and alcohol testing programs/systems are often implemented as management tools. Other options include mandated counseling/treatment, home confinement (ankle bracelet) etc.

Research on the actual effectiveness of these deterrent programs is mixed. Looking at the "bigger picture", most research strongly suggests that punishment (or the fear of it) has little impact on changing human behavior and, in turn, reducing crime. One example cited often are penalties (prison sentences) for sex offenses and drug crimes. State lawmakers and Congress have enhanced penalties for the last 20 years (e.g. the "war on crime"), yet crime rates remain stagnant or are increasing. As much or more drug-dealing activity now as compared to two decades ago.

Point is, if we had laws that hard, lots more people would THINK before going out and getting drunk without a sober driver. I don't care if you get drunk, have at it. BUT, would you drive if you knew you were going to jail for your crimes? I'm sure some still would, BUT I'm willing to bet there would be lots less in prison than u think. Idiot drunks just don't care right now because this state pampers drunk drivers by letting them get 10-12-etc DUIs. Like Goth said, it's a privledge, not a fricken right. Same for BUIs.

posted by: Mad Dog. I love hearing the guys who say prosecute poachers and wildlife violations to max penalty but think it is just one of those things about driving drunk. The thing about drunk drivers............... they do it all the time until they get caught. I have known guys all my life that drink a six pack and drive home. I hate drunk drivers. I think it is a major crime and needs to be treated like one. IMO. Take their car, take their lic. and thrown them in jail for 30 days............. second time............. the same but a year........... third time............ 3 years w/ a 6 ' 10 gay guy with love on his mind in a 6 x6 cell.
