Posted Section Lines

.ExternalClass .EC_hmmessage P {padding:0px;} .ExternalClass body.EC_hmmessage {font-size:10pt;font-family:Verdana;} I recently ran into a situation where a landowners daughter denied me the right to walk a posted section line to get to a dam to fish.  I understand that the landowner has had issues in the past with some individuals leaving their trash on their property and by the dam and I also have an issue with that.  If I am understanding correctly posted section lines even though closed to hunting may still be traveled.   Any info?

From what my understanding is, there is 33' on either side of the section line that is open to public travel, unless the landowner has gone through the necessary requirements to get the section line closed.  All i can say is make sure it is a true section line and not a quarter line because quarter lines are not open to public travel.  There is a good chance that most landowners have not closed their section lines unless for a really good reason.  Also i believe there is a certain amount of public access along the banks of certain streams and creeks.  Not sure on the last one though.

North Dakota laws address property ownership for hunting on section lines adjacent to posted land.  I have never read a law concerning fishing.  Nagivatable streams are supposed to be open for access to the normal high water mark.  My brother could help on this one.  I would call the County Sherriff before the game warden.  I did talk to Dale at the G & F dept. two years ago about this issue.  You need to insure the section line has not been abandoned.  This will be recorded in the township records.  Be care full. Best not to trespass.  Explain to the  adjacent landowner what you are doing. When all else fails launch a boat from a public  road ditch and stay on the water.  Asssuming it is a river.  Or find another landowner willing to grant access.
