ND House Votes To Keep Nickname

BISMARCK – The North Dakota House has voted to keep the University of North Dakota’s Fighting Sioux nickname and logo.

 

On a 65-28 vote, the House approved House Bill 1263, which states University of North Dakota athletic teams shall be known as the Fighting Sioux. Neither UND nor the state Board of Higher Education may take action to discontinue the use of the nickname or logo.

 

It requires the attorney general to consider filing a federal antitrust claim against the NCAA if the association takes any action to penalize UND for using the nickname and logo.

 

The bill will now move on to the Senate for further discussion.

keeps it outright, they cant force a vote at SR because their constitution does not allow it
Many believe the ceremony at Standing Rock back in the day gives the right to the logo, many tribal members convinced the legislature to keep the logo

I will be even more ecstatic if the Senate passes it as well…I feel it may be tied up in the courts if the higher ED Board has anything to say about it…since the state will be contradicting a ruling of theirs…of course if the Board wouldn’t of F’d up in the first place none of this would be necessary.

I am a UND grad and huge UND sports fan.  I think it's terrible that the Standing Rock tribal council won't allow a vote, which no doubt would have resulted in strong support to keep the name.    Having said that, this bill is on it's face violates our state constitution.  The attorney general has already pointed that out but the House decided to pass the bill anyway.   Unfortunately even if the Senate were to pass it it will likely be voided by an AG opinion or the courts.......Too bad....

On what grounds does the AG feel it's unconstitutional.  I'm for taking this to the SCOTUS if needed.

The sacred ceremony in which the Sioux nation gifted the name to UND some 80 years ago is the reason that this should NOT be undone. I am glad that it passed the House, but I have my doubts about the Senate. I would be willing to bet that Wayne will tell his brother Bob to make this go away. I would hope the name could stay.

The legal issues deal with the state constitution so it is highly unlikely any federal court would have jurisdiction to hear the case.    I am no expert on the particulars, but I believe the constitutional issues deal with seperation of powers.  The Board of High Ed is given by the constitution authority over about everything dealing with higher ed schools, except the amount of money the legislature gives them.   The Gov. doesn't even have to approve their budget.  With this bill the legislature is acting on issues reserved by the constitution for the board of higher ed.   When the tribal members from Spirit Lake sued the state over it's intent to change the nickname the ND supreme court ruled that those types of matters are within the jurisdiction of the board of higher ed to decide.    It's a bad system civics wise because unelected boards shouldn't have so much power.   But it is what it is.   Wayne Stenehjem would probably love to keep the name also, but he has to do his job also.....

Alot of people are passionate about keeping the nickname.  People wondering if it will ever end? If you dont want to read about it dont click on the topic.  Im sure all of us are passionate about hunting/fishing and we dont just give up on our rights because were tired of hearing about it. Fight it to the bitter end!

So what your saying is to get it done they would have to stop funding UND through the legislature.  I'm guessing given the political climate in the country right now and the boiling point of this particular issue, that would be a consideration.  It would be like shutting down the country like D.C. has done before.  Major league arm twisting.  I wouldn't rule it out.  In fact it is would be a brilliant move considering 70 some percent are in favor of keeping the name.

70%?  Are you kidding?  Provide the source of this bs.  I bet 70% of North Dakotans don't care how this turns out, just that it ends.

So, I'm thinking... if the House knows that this could be nullified by the courts based on constitutionality, could it be that they went ahead and did it anyhow so they can still look good in the eyes of those that care while fully knowing that in the end it won't matter anyhow?  

I am obviously ignorant, because I just cannot understand for the life of me how the name and/or logo is offensive to people.  Very strange to me.

Well, at the very least it may delay the switch to the UND Fighting Squirrels.
