DUI: Ward County Joins the 24/7 Restriction

I read in the Minot Daily this morning that Ward County has adopted the 24/7 alcohol restriction order for second time DUI offenders.  It means that 2nd offenders will have to comply with 24/7 AM and PM breath testing.  I don't know the specifics, but if they test positive for alcohol they are rearrested on the spot.

The state claims a 98% compliance rate under this new program.  They also claim that North Dakota is now number 1 in DUI arrests per capita nationwide. ND Arrest rate:1 DUI arrest for every 100 ND residents with well over 6,000 DUI arrests last year.

We were discussing this thing in my DUI class tonight...It is an added self-inflicted inconvenience which will put a major monkey wrench in a drunk driving offender's life.

1)  He or she will not be able to legally consume alcohol for quite a while.
2) They will not be able to sleep in.
3) They will not be able to travel very far from town for who knows how long.
4) These breathalyzer tests are paid for by the offender 2x daily.
5)  We realized summer boat fishing would be difficult with this sort of schedule.
6)  Camping is out of the question.
7)  Early morning or late evening hunting out of a tree stand is not an option on this schedule.
8)   Your job may require you to be out of town.
9)  More?
10)  ?
11)  ?
12)  ?

i believe it only applies in that time period between when you get charged to the time you plead guilty.  might last until you actually sit your five days in jail.  can't remember.

The paper reported that Craig Irwin was on the program for 8-12 weeks prior to his 5 year prison sentence for his 15th DUI conviction.  This program is not just a 5 day or even a two week program.  It goes on indefinately.  The time length for each individual will be dictated by the judges in that district.  It will be interesting to learn the details.  Stizo :)

I don't know about North Dakota laws, but I do know in some states you can get DUI or whatever they would call it while on horseback if your intoxicated. Makes me a bit nervous when I saddle up old Shorty for a ride and take a few brewskys with me in the saddle bags. As long as I stay back in the hills it shouldn't be a problem, except old Shorty doesn't like it when I don't share my beer with him.

   Another example of our lawmakers stupidity. They take your license away and then tell you to come in twice a day for a breathalyzer, I'm sorry but how the hell am I supposed to get there???  Especially if you live out of town.  Not condoning drinking drinking and driving but this law makes absolutely no sense.  Very seldom drink anymore but if this ever happened to me I guess you all would be paying for my room and board, I'm nearly 25 miles from town so twice a day breathalyzers is not an option.

Should have thought of that before you drove!


1.) He said he wasn't condoning drinking and driving
2.) I don't think he was talking about himself
3.) I was on 45 days "House Arrest" 6 years ago for a DUI. I had to blow into a machine like 7,000 times a day when I wasn't at work. Couldn't go more than 7 feet outside my house. This really isn't anything new I don't think? Maybe I'm wrong.

Also, after they get their license suspended, I don't think they need to "travel" at all. The machine hooks up to a landline and when it rings, you talk into it. FYI chewing tobacco will show up as "alcohol" also, if you had a dip in a couple minutes beforehand-(shoud be number 10 on Stizo's list!)

Yeah Yeah Yeah, don't drink and drive, we know, we know. On the other hand though, to play Devils Advocate, I think there should be much more severe punishment for other crimes like illegal substance, firearms "violations", big game vilolations, and I think ALLLLLL sex offender type crimes should immediately result in removal of the guys weiner.

i sat in on a meeting w/ the local bar where the guy setting up and promoting this program gave a presentation.  i am 99% certain the 24/7 program only runs while the offender is out on bond until the they start serving their jail time.  once you go to jail and serve your time, the 24/7 program ends.  it does not go on indefinitely.
