 I wonder who "Sporting Goods Properties, Inc." is.  Any one know?  Shooting range or gun shop near Grafton or might it be a subsidiary of Remington?

  You got that right Jake.  Wonder how he will explain having a loaded rifle in his pickup and his negligence apparently breaking the law.

Coyote hunting?

I have a couple remingtons my pickup. I throw them down under my tire for traction when I get stuck in the snow.

I googled them....looks like a subsidary company to Remington who performs their production testing on guns and ammo.

Legally he could have chambered a cartridge after his vehicle was in "P" for park and grabbed the muzzle of the rifle to shoot at a predator from hi vehicle... but I do dispise gray, thin areas of the law for dipshits like this...

Besides that, if he wins anything on this lawsuit, do you think he cares if he is found guilty on a game & fish charge...

The coil wasn't red on my stove.  As I went to pull it out, to clean grease out of the pan, I seared my fingers.  I bent to pick up a LITTLE box from the floor.  It was full of bolts.  I hurt my back and mashed my toe.  I tested the edge on a very sharp knife too aggresively and lacerated my thumb.  I then closed it too quickly, while pissed off with a slick, bloody hand and severed a portion of my index finger tip.  I think I'll pick up a gun by the muzzle next as I already should own the state of WV.  Good excuse to buy a .243.

Obviously he needs to go back to hunters safety! Muzzle control!! Muzzle control!! Muzzle control!!!! Treat a gun as it's always loaded, if you always keep the muzzle pointed in a safe direction you don't have accidents like this! If I was the courts I'd say he's 99% liable even if the gun malfunctioned!

What is really more disturbing is that there is a lawyer who is willing to try and win a case like this! My gut is telling me that the attorney is likely hoping for a settlement.

In regards to how one can be shot in the hand and leg? Likely the gun was being pulled toward him with the hand over the top of the muzzle. Not bright to pull the hot end of a firearm toward you at any time!

But I think back to many of the old timers and how they carried the rifles or shotguns. Most had them pointing up would bring the muzzle across the front of their face and out the window to shoot gophers,skunks and such. Always made me nervous!
In my lifetime I have seen fence row to fence row farming and the return of CRP and game to the landscape.Now we face again the prosepect of fence row to fence row again! Sportsman are our own worst enemy in that we fail to look forward and focus to much on the now!

I think its two seperate issues.
1. If the gun did malfunction and fired on its own, then he is entitled to compensation, meaning a new gun or a repair on his current one. Thats just customer service.
2. I know that the owners manual for all firearms states clearly that the muzzle is to be pointed on a safe direction at all times so I guess Remington could actually say that it is a breach of contract that he didn't. I think the injury is a mute point.

 Regardless the verdict, that the suit's been brought means that shortly we're all paying more for everything Remington.  I wonder if Cerberus is in some way insulated from lawsuits against Remington?  If not and atty fees and judgements are spread across all Cerberus holdings then we're all going to be paying more for Bushmaster, Barnes bullets, Marlin, DPMS, as well as Remington (and probably others).
