Can I get a gratis tag if my dad owns the land?

Hey guys I was wondering if I can get a gratis tag for deer if my dad owns or leases land? Can he transfer the gratis over to me or can we both get one? I  know i should probably ask a game warden but i figured some of you guys could help me first

Resident Gratis and Nonresident Landowner - Licenses are available to residents and nonresidents who own, or residents who lease for agricultural purposes and actively farm or ranch, at least 160 acres of land located in an open hunting area. These licenses are valid only upon land described on the license. The resident gratis or nonresident landowner license may be used during the deer bow, deer gun or muzzleloader seasons until the license is filled. Resident gratis and nonresident landowner licenses are issued only through the Department’s Bismarck office and are subtracted from the maximum number of deer gun licenses available (nonresident landowner from the one percent allocation), for each unit. A resident who holds a valid lottery license to hunt deer may hunt the same species and sex of deer, for which that person’s license is valid, on land in an adjoining unit for which that person would be eligible for a resident gratis deer license. A person, that person’s spouse, and their children who have a gratis deer license may hunt together on any qualifying land described on any of their licenses provided they hunt within the same unit in which their described land is located. No other licenses are required for resident gratis licensees.

He can transfer his gratis to you but then can't get one also. If your mom's name is on the title she can get one also but she can't use the same land description.  Your dad also must have the hunting rights on the rented land on the lease.  I think one reason for that is to make sure the landowner and the renter arn't both putting in for the same piece of property.

It depends if your dad owns at least 160 acres and how old you are.. You need to be a legal dependent. I'm not sure what exactly what the G and F go by for legal dependent. I thought it was any children under the age of 19, or under 25 if going to school full time.

Im 23 years old, we own some land and rent some land around 600 acres. One of my friends told me that my dad can transfer the gratis license to me but i wasn't sure about it thats why i thought i'd ask. I have the hunting rights to the rented land to hunt deer. Has anyone ever had a gratis transfered to them, Would it be something that has to be done when sending in application

I think you are too old.   Why don't you do the lease to farm some of it, then you can get your own license.  On the other hand just put in for a regular unit license.  It's only twenty bucks.  I thought the age for legal dependent was 22 for taxes.  That might be what they mean too.

Just a heads up on a Gratis tag if you get one, Do not  i repeat Dont post pictures on this website  if you get a buck .  The photo police will tear you apart, and call you a poacher, a cheater, and every other name just cuz you bagged a deer with gratis. It happens every year.   Prime example is the 'Captian Ahab' forum now, some ppl just cant get over seen other ppl do better then them.

You are getting dangerously close to the age you cannot get a gratis tag any longer.  I can't remember if it is 23 or 25 years-old.  But it is one of them.  You'll basically have to have your dad transfer over your name to 160 acres from there on out.  Or be living and able to prove you are actively farming with him or the family.

The NDGF cannot spot check everyone but I know two people that were refused tags once they reached the certain age.

Just call the NDGF.  Some on here think it is impossible to get a response but I've never had an email turned down nor a phone call abruptly ended or ignored.  Perhaps it is some people's approach when they make their initial contact?  Not sure.

There are ways to get it.  Even if you have to lease the land for a penny a acre, there is ways.

I dont think the age matters as far as I know, but legally you must reside at the same residence as your parents or you do not qualify to get it transfered.

An individual who is eligible for a license under this subsection may transfer that eligibility for the license to a spouse or legal dependent residing customarily with that individual, but no more than one license may be issued under this subsection for any qualifying land.

It depends on the ND G and F interpertation of a legal dependent. i just emailed them, I'll let you know what they say.

I am pretty sure there is an age requirement.  It is in place because of college I believe.  Or in other words, a kid that is 18 to 19 years-old going to college I think still qualifies for a transfer even if not living with their parents.  That's why I am pretty sure age 23 or 25 is the mark.  Often times that's about graduation age.

I was wondering if maybe you could clarify this statement a little bit, and specifically what the G and F considers a legal dependent. As I understand it, a legal dependent is considered children or ward under the age of 19, or under the age of 25 if a full time student.

I'm assuming if you're over the age of 19 and not a full time student, just because you live with your parents/ land owners, that you are not eligible for the gratis tag to be transferred to you.

This is what I got back from Timian


In the gratis law there is no age on dependent.   If they are your legal dependent and live with you then they qualify to have eligibility transferred to them.  If you have specific questions related to gratis, please feel free to call me at 701-328-6324, as the gratis law over the years has become more complicated.

Well that is very interesting.  So if I put my permanent address down as the farm I can hunt dad's land with his gratis tag until I'm dead?

I swear on the bible I know such a thing existed.  Perhaps that is what it is meant by "it has become more complicated."

Or what strikes me is if a college kid lives in Grand Forks or wherever for most of the year cannot get a gratis tag transfered to him.  Strange, strange, strange.

Yeah, that seems weird to me too. It raised some more question actually, but I'll wait closer to deer season to give him a call, not all that worried about now I guess. I would think college kids would be ok, I think alot of them still list there home address

When I moved to Grand Forks and had to update my address I got my address in Grand Forks because it just made things easier.  But really, I was still "dependant" on the parents and moved there in the summer.

Yeah, I don't know, strange deal.  Maybe they mean dependant as in tax dependant.  But that's not right either as I was paying income and social security when I was in high shool!
