Brooklyn teen faces felony charge in death of family hamster

NEW YORK (Reuters) – A New York teenager has been charged with a felony, with the possibility of a two-year prison sentence, for killing her family's pet hamster, authorities said on Wednesday.

Monique Smith, 19, of Brooklyn was arguing with a family member in June when she reached for the hamster, choked it and threw it outside the house, police said.

Her arrest stemmed from an investigation into the incident after Smith's father contacted the America Society for the Prevention of Cruelty to Animals, said ASPCA assistant director Joe Pentangelo.

Smith is charged with one felony count of aggravated cruelty to animals. If convicted, she faces the possibility of two years in prison.

"Sadly, very often, pets find themselves in the middle of these situations," said Pentangelo.

"A family will have a disagreement and unfortunately the animal is the recipient of misdirected or redirected rage."

The hamster died from blunt force trauma, liver damage and a brain hemorrhage, he said.

A grand jury selection to consider Smith's case is set to begin on Friday in Brooklyn Criminal Court.

 BISMARCK, N.D. (AP) - North Dakota law should include a felony penalty for people who are convicted of animal cruelty, a shelter administrator said Friday, listing cases she said deserved harsh punishment.

Sue Buchholz, director of the Central Dakota Humane Society's shelter north of Mandan, told the North Dakota Senate's Agriculture Committee on Friday of a cat that survived being "cooked" in a microwave oven, and a puppy that died after a man stomped its head in front of his girlfriend.

"We've had dogs with an open leg wound, torn to the bone, the owner was well aware of it (and) did nothing," she said during a committee hearing Friday. "It was left to suffer without any medical care."

At present, North Dakota's harshest punishment for animal cruelty is a misdemeanor that carries a maximum penalty of a year in jail and a $2,000 fine. The legislation reviewed by the Agriculture Committee on Friday says repeat offenders can be charged with a felony that carries a five-year prison term and a $5,000 fine. The committee did not take action on the measure Friday.

Representatives of the North Dakota Farmers Union and the North Dakota Stockmen's Association said they did not object to harsher penalties for animal cruelty. However, they preferred a legislative study of the issue, rather than approval of the pending bill, they said. It is sponsored by Sen. Jim Dotzenrod, D-Wyndmere.

Woody Barth, a Farmers Union spokesman, said the legislation had grown to a 14-page bill after starting out as a four-page measure. Julie Ellingson, director of the Stockmen's Association, said association officials wanted to make sure the legislation would not cause unintended problems for livestock operations.

Should a study take place, the subject of appropriate penalties for animal cruelty would be examined by an interim legislative committee, which could then recommend a bill for the 2013 Legislature.

Barth said the job of drafting legislation for the 2011 session stalled when the leader of the effort, Cynthia Feland, a former assistant Burleigh County state's attorney, was elected to a state district judgeship last November.

Buchholz said she did not want a delay, and said she preferred to have egregious first-time offenders prosecuted for felonies.

"We feel as we wait to discuss the matter further, more animals will suffer abuse and neglect," she said. "We are disappointed that our interim work . did not yield the result that would prove a meaningful deterrent for intentional and needless cruelty to animals."

The Animal Legal Defense Fund, which is based in Cotati, Calif., ranks North Dakota as one of five states where animal protection laws are the most inadequate.

North Dakota has no felony penalty for animal cruelty or abandonment, does not restrict animal abusers from owning animals in the future, and does not require mental health evaluations or counseling for offenders, the organization said in a 2010 report.

Daryl Lies, of Douglas, who tours county and state fairs with a "racing pigs" entertainment show, said he was troubled by several aspects of the proposed new animal-cruelty law.

One provision would allow a law officer to seize an animal for its own protection without a warrant if the officer believed the animal was being abused, he said.

"They can come take them on a report of a jealous neighbor. They can come and seize them on false reports of lack of water," Lies said. "Be careful what you do. Be careful what you ask for."

Evidently the state of NY city of Brooklyn does. Seems a little much for me. How do they know the abuse was caused from the gal and that the liver damage wasn't the result of genetics or binge drinking?

OK, I will say those who choke hamsters, slit dog's throats, stomp puppies etc need to be shot; several times at 350yds with Varmit Grenades.

I found out that when my mom was little, her cat had kittens. They coudln't sell them and back then there was no such thing as a humane society. Grandma hated then and still does hate guns. My grandma apparently took some duct work, cut a hole in a cardboard box, and rigged up a gas chamber attached to a car. She put the kittens in the box, taped it shut, and turned on the car on and gassed them to death.

Funny how things have changed. Still, I can't believe my grandma did that!

If things were the way they are now 20 years ago I would have been in some serious trouble.  When I was roughly 4 years of age my mother had taken me to someones house who had a whole bunch of baby hamsters, and before I left, every single one of them was dead.

I must have thought they were toys.  Oops.
The wheel is spinning..but the hamster is dead.

I love grandmas and don't want to put your grandma down, but that is a pretty crazy thing to do.

So where do we stop making crimes a felony?

Before anyone questions my commitment to treating animals in a humane manner, years ago I kicked the shit out of a jackass that booted a year old pup across the barn ultimately killing it a day later simply because he was mad at a PUP for being in the wrong spot when sorting cattle. At the time in the state it happened I could have been charged with a felony given the circumstances if it had been pursued. I understand that. And yet killing a hamster and becoming a felon I do not understand.

People don't think outside the here and now when supporting these potential laws. Right now we say this is a legitimate law, society will not push the judicial system to use this law unless it is an extreme case. What about 30 years down the road when these laws are still on the books and society continues to move in the direction it is. How soon before a warden seing you using a shot collar 3 times in 5 years on your hunting dog results in a felony charge? How long before a Grandma faces a felony charge for geting rid of kittens in a relatively humane manner?
(explain the actual difference from the kittens perspective of between being put to sleep in a vets office by an injection or being gassed in a box? )

Perhaps this is a bit of an insight into why some of these states are broke. How much does it cost to incarcerate someone under a felony conviction? Now this fella that kills a hamster is going to cost the taxpayer how many dollars? Fine the hell out of him if you want, but stop and think about the consequences of a felony status on these type of crimes.

I FIRMLY beleive in the humane treatment of animals, I make a good part of my living and spend hours in some pretty inclement weather making sure my animals are properly cared for. But I stil realize they are animals, not humans, and question the wisdom of those who do not make that distinction. I also question the wisdom of turning more and more crimes such as these  and who knows what potential ones into a felony status and what it will ultimately do to our judicial system and society as a whole.

Now not only will the guy shooting a squirrel with a high powered rifle be sitting in the pen with his fellow rapists and murdering felons, he will be joined by that dastardly serial hamster killer as well.

What the heck, I'll bite.

Last spring there was many prairie dogs out west that died of "liver damage". Not to mention other health issues.

That father needs his ass kicked in my mind. Discipline your children and they wont be throwing the pet hamster against the wall in the first place. And let's for arguement's sake say it did happen, would I call the police in today's f'ed up day and age, hell no! Because I would know that this sort of stupid crap would be the result.

Guess I might just buy another damn hamster, or not, they stink like hell.
