I boat my boat in SD as well. I think you have to pay the sales tax using the form below and then have to provide proof of payment when you register the boat. At least that's what I remember.

When I purchased a boat in SD I simply went to my local G&F office with a purchase agreement and paid the tax while purchasing the boat license.  I had to pay 5% of the purchase price.

 If you buy it from a private seller theres no tax on it. Only if you buy it from a dealership.

I second your "correct".  This was brought up last year about this time.

 I agree same thing happened to me. I didnt have to attach anything when I registered it though.

So, no tax, just call G&F and get it licensed?

You need to present a copy of the sales agreement w/ the seller's info at the time of licensing.

I never had to provide anything but the old registration card proving that the previous owner had signed off and that I could register the boat in my name. Only the friggen DMV worries about sale tax on a vehicle.

Good deal!  I just bought a boat the same way.  Was hoping not to have to pay sales tax to.

Sorry guys but you are wrong....you need to pay the sales tax....private party does not matter if it was purchased out of state and brought into ND.

Had a buddy just get burned on a sales tax audit for the tax on his boat....and I just called the sales tax dept to verify.

Nope, pretty sure you are wrong.  I specifically asked when licensing my boat for the 1st time.  If it is a used boat from a private party, no sales tax.  Like what was said before, bring in the old registration with the sellers signature, license, and go fishing.  Here is a link to this discussion last year.  I believe the reason is that boats are not titled in ND, just registered.  Hence, there is still tax on private party used vehicles.

No.  You are wrong. 
private party sale = no tax  (in state or out of state sale)
dealer sale = tax   (in state or out of state sale) 

I apologize guys....I did just call the state tax dept and ask...imagine I was given the wrong answer from them....and I know my buddy paid his $$ on his boat purchase from SD....I will be calling him immediately on this.

There is definitely no tax if it was bought in state from a private party.  All I had the seller do was sign the registration card that you get when you register your boat in ND and bring that to the G&F when you register it in your name.  Not sure if buying out of state would be different...wouldn't you need to go by SD's laws if it was bought there?
