Bismarck rancher sentenced in deer killing

BISMARCK — A Bismarck rancher who pleaded guilty to killing deer in his daughter's feedlot to keep them from damaging feed will spend four days in jail and pay $8,500 in restitution to the state.

 

The Bismarck Tribune reports that 69-year-old William Dethloff had a second restitution hearing on Thursday in which the judge reordered the same sentence and restitution he had handed down in January.

 

Dethloff pleaded guilty to eight counts of unlawful taking of big game and nine counts of unlawful possession of big game animals in Burleigh County.

 

He had sought to be allowed to present evidence that he had no other alternative, but a judge ruled that the crimes were "strict liability" offenses.

 

Court documents say a state wildlife investigator found the dead deer in February.

Agreed, does anyone know this situation? was it truly a case of feed loss or was he just shooting deer?

If it was feed loss he could have put up a fence .  I've done it  and had no further problems.   This guy seemed to be taking a short cut.

Just imagine how much fence you could put up in four days if you had an extra $8500 laying around. I think it serves him right!

I'd say he got off pretty easy.

"He said he paid a $200 fine in 1997 for shooting 56 and now faces fines of more than $29,000 for shooting 36 deer."


The court ordered him to a deer-proof hay yard by a Nov. 1, 1997, deadline. The state delivered more than $1,400 in materials to build it, but Dethloff didn’t build it — at least the way the state required.

“We lined our corral with it, so the deer wouldn’t crawl into the feed bunks,” Dethloff says.

He had 2,700 bales at the time, which he says the approved enclosure wouldn’t have held.

“It probably would have held 200 bales,” he says.

In 1999, Dethloff explained to wardens that he

“didn’t want the hassle of getting on and off his tractor to open gates four times a day.”

I'd bet lots of hunters in Bismarck would have gladly help him with his deer problem, but I'd bet he didn't want to stoop that low.....allowing a lowly peasant the opportunity to hunt his land.

This guy is/was unreasonable. Not a nice guy.  He got what he deserved, maybe less.

 I would turn and go after g-n-f for damages caused by their deer. If my cattle got out and wrecked my neighbors crops i would be found liable. Why should i have to put up a fence to keep my neighbors herd out of my feed? Hell, I think I side with the rancher. This judge is an idiot!

Yeah.  The guy's a real dickhead.  I work with someone who asked to hunt there one time, and he said no.

Is it their fault he built a farm where deer live, I understand it would suck to hae abillion deer eating up feed and money, but seriously there are other ways around it besides slaughtering them all, plus what did he do with them after shooting them?????did he eat them?

 I support Game and Fish, they do an awesome job at what they do to manage things. With that said, a guy has a right to defend his property. What the deer are doing is stealing. No different than you or I walking into someones garden and picking and eating all the peas. 
As far as Swannys question to where the deer live. Should we be living on the Land the Indians owned? 
The rancher in this case maybe went a wee bit extreme here but IMHO, the judge in this case is the idiot. Again, it comes down to one protecting their property.

What's kind of funny is that the law has since been changed mostly because of Dethlof, but it doesn't help him at all because his actions were before the law change. Now, Game and Fish can open up shooting of deer that are congregated in an area outside of the regular season.
A couple points I've made before for people who don't run livestock.
First, a deer fence is a huge pain in the you know what when there is snow, like the last couple winters. Opening gates that are snowed/drifted in every single day is a whole lot of work. More gates, especially big deer proof ones, would be a nightmare.
Second, hunting during the season has little to do with deer problems in a feedlot. In November, the deer aren't causing the problems. They are causing the problems in January, February, March, when the snow has been deep and their feed sources are running now.
Third, I've been to Dethloff's feedlot. It isn't very big. They have a barn/shop, two houses, and a whole bunch of cattle (at times) in the lot. About the last thing they would want is a bunch of strangers in there shooting. I wouldn't want people shooting that close to my home and business. Probably why he said no to Jimidiet's friend. 
Anyway, I don't think Dethloff was wrong and I would have probably done the same thing. On the other hand, I don't think the judge ruled incorrectly either, because he was following the law on the books. Really, nobody could win in this situation.

well that was obviously sarcasim, protecting your property and killing a shitload of deer are 2 different things, they gave him material to build fence around feed yard or bales, if it wasn't enough i am sure he could buy more and write it off come tax season, I think he was just too dam lazy to do anything about it, his idea was bullets are cheaper. either way it sucks and he should have gotten more , or maybe stay the fines if he builds the fence and gates.
